About the Paper

Dr Craig will discuss his much-awaited book on the royal prerogative. He argues that all non-statutory powers of central government derive from the prerogative powers of the Crown. This means challenging a large amount of case law and a highly influential line of academic opinion running from Blackstone through to Wade and Harris. Dr Craig argues that the Crown has no common law powers as such, or ‘third source’ powers or freedoms as suggested by Harris. Instead, recent case law considering third source powers must be reconsidered as examples of judicial regulation of prerogative powers - including an often-overlooked and controversial prerogative power to administer the realm.
